Grand jury indicts man on 10 charges

A grand jury indicted a man on 10 charges Feb. 19 following a December incident when Kentucky State Police troopers attempted to pull him over for not wearing his seat belt and he allegedly fled.

When troopers activated emergency equipment behind Tovon McFarland, 22, Lexington, on North Third Street, they saw him put on his seat belt and accelerate, according to a previous Register article. McFarland, who had a passenger in the vehicle, also passed the car in front of him by going into oncoming traffic in a no-passing zone.

McFarland continued onto North Wilderness Trail, where he went over an embankment and into a residential yard, a citation states. He regained control of the vehicle, went back onto the road and continued toward the bypass, according to the citation. He ignored a red light and continued west on the bypass.

While driving on the bypass, McFarland's front tire blew, but he continued driving, the citation states. He then turned onto McCord Lane, went to the end and wrecked the vehicle. McFarland exited the vehicle and then fled on foot.

Troopers told him to stop multiple times, but McFarland kept running, according to the citation. Troopers were able to eventually apprehend him. Troopers learned the vehicle had been reported as stolen out of Lexington. McFarland refused to talk with police, but told police he would take all responsibility because the passenger had nothing to do with anything.

The indictment charges McFarland with receiving stolen property (less than $10,000), first-degree fleeing or evading police, second-degree fleeing or evading police, first-degree criminal mischief, third-degree criminal mischief, disregarding a traffic control device, reckless driving, failure to wear seat belts and second-degree persistent felony offender.

• Timothy Martin, 30, Peachtree, Berea, first-degree controlled substance trafficking (more than 2 grams of methamphetamine), drug paraphernalia possession and marijuana possession.

• Floyd Neely, 47, Galloway Lane, Berea, first-degree controlled substance trafficking (less than 2 grams of methamphetamine), two counts of third-degree controlled substance possession and drug paraphernalia possession.

• Kerry Cooper, 36, Morgan Street, Berea, two counts of first-degree wanton endangerment, two counts of first-degree fleeing or evading police and second-degree fleeing or evading police.

• Michael Todd, 50, Eubank, first-degree controlled substance possession, third-degree controlled substance possession and drug paraphernalia possession.

• Leslie Maggard, 46, Beattyville, first-degree controlled substance possession, drug paraphernalia possession and failure to use turn signal.

• Paul Mitchem, 33, Lambardy, Richmond, first-degree controlled substance possession and drug paraphernalia possession.

• Brandy Davis, 31, Sombero Drive, Richmond, first-degree controlled substance possession and drug paraphernalia possession.

• Tara Haines, 42, Taylor Drive, Richmond, first-degree controlled substance possession.

• Frederick Williams, 27, Bluegrass Homes, Richmond, second-degree escape and tampering with a prisoner monitoring device.

• Tonya Golden, 33, McKee, theft by failure to make required disposition of property.

• James Neal, 32, homeless, Richmond, unauthorized use of a motor vehicle and operating a motor vehicle on a suspended license.

• Andrew Buster Jr., 33, Lexington, second-degree criminal possession of a forged instrument.

• Jessie Rodgers, 41, Lexington, flagrant non-support.

• Marquel Johnson, age and address unknown, first-degree bail jumping and second-degree persistent felony offender.

• Jesse Vessels, age and address unknown, tampering with physical evidence.

The grand jury voted to recommend charges be dismissed that are pending against the following:

• Shirlene Carter, age and address unknown; and Frederick Williams, age and address unknown.

An indictment does not indicate guilt, only that grand jurors believe the state has enough evidence to proceed with prosecution.
