Brandi Whitaker, the Madison Southern High School teacher facing criminal charges for engaging in sexual relations with a student, resigned Aug. 27.

The resignation was accepted, said Erin Stewart, county school district spokesperson

Whitaker was suspended following her Aug. 25 arrest. She was arraigned in Madison District Court the next day and released from the Madison County Detention Center on a $10,000 the same day she resigned.

On Sept. 2, Whitaker waived her right to a preliminary hearing and Madison District Judge Earl-Ray Neal referred the case to a grand jury. The victim’s father is asking authorities to drop the case, Whitaker’s attorney, James Baechtold, told Neal.

According to Berea Police, Whitaker admitted she has engaged in sex with the student on two occasions over the summer.
