Couple sues hospital over infant’s death

A Richmond couple has sued Pattie A. Clay Regional Medical Center, claiming that negligence on the hospital’s part allowed their newborn daughter to contract an infection that led to her death.

Darvin Schulz and Katherine Havens filed suit Sept. 9 in Madison Circuit Court seeking a judgment — in excess of $4,000 — that “will fairly compensate” the parents for the death of their child, as well as the child’s estate.

Havens was admitted to the medical center on Aug. 10, 2008, and gave birth to a baby girl, Autumn Shulz, the following day.

According to the suit, Havens was not treated for a positive Group B Streptococcus condition, which it states the hospital knew to exist.

As a result, the suit alleges, the infant suffered “significant injury” that resulted in her death 11 days after her birth.

Without offering details, the suit claims the medical center’s actions “deviated from the accepted standards of medical care,” constituting “medical negligence.” It also claims the infant’s death was a “direct and proximate result” of the hospital’s alleged negligence.

The hospital’s attorneys have responded to the suit by submitting a list of questions, which it asks the court to have the plaintiffs answer.
