Berea clears legal hurdle for US 25 Yard Sale, June 6-8

BEREA — The Berea City Council Tuesday amended the city’s yard sale ordinance to accommodate residents wanting to participate in the US 25 Yard Sale, June 6-8.

The amendment also establishes limits on the number and frequency of yard or garage sales that can be held within the city limits.

Section 52.003 of the garage and yard sale ordinance was amended to establish the city’s code department as the administrative enforcement office for yard and garage sales.

It limits permits to be issued to any person for no more than three sales on two consecutive days, or two sales on three consecutive days within a 12-month period. Permits will not be issued for any location more than three times within a 12-month period, and there must be a 30-day interval between any sales within the 12-month period.

The amended policy also establishes guidelines for yard sales by non-profit groups, clubs and professional fundraisers.

Those three groups can hold sales in commercial zones with the permission of the property owners. The groups can hold 10 such sales of two days each at a single location. Adequate off-street parking must be provided and the property owner’s permission presented in writing with the permit application.

Permits issued for the US 25 Yard Sale will not count against the number of licenses permitted, nor the 30-day interval period between yard sales.

US 25 Yard Sale permits will be valid for the event’s three days. They will contain additional restrictions assuring that adequate parking is available. No parking will be allowed in emergency pull-off areas on the sides of the roadways.

Organizers of the US 25 Yard Sale, now in its second year, hope to eventually see the sale extend from Covington in northern Kentucky, to New Brunswick, Ga.

The council also heard first reading on an abandoned property ordinance which would establishes procedures for dealing with abandoned property within the city limits.

The ordinance will require creditors of abandoned property that has been foreclosed upon to maintain that property during and subsequent to the foreclosure.

Vacated building maintenance standards are included in the ordinance that sets a $60 registration fee for abandoned residential property.

It also includes a penalty provision to provide notification of violation of enforcement by the code enforcement board and an appellate procedure.

In other business the council:

• Opened bids for the Water Street drainage improvement project. The seven companies submitting bids, high-to-low bid were: WPG of Richmond; $329,931, Keaton Enterprises; Richmond, $324,888, Grants Excavating; Richmond $295,524, The Allen Company; Lexington $258,804, LAGCO Inc.; Lexington $249,141, DMH Construction, Winchester $194,427 and Ford Construction: Lancaster $186,000.

The council had budgeted $298,000 for the project. Engineering projections for the project were $229,000.

The bids will be referred to city engineers for their recommendations and brought to the council at its next meeting.
