Zackary Flower murder trial delayed

Case was to be tried Monday

RICHMOND — The Zackary Flower murder trial, scheduled to start Monday, has been delayed and no future date has been set, according to court officials.

Matthew Denholm, 29, and his brother, Ryan Denholm, 32, are charged with murder in Flower’s 2011 shooting death in Berea. Two other people, Sherry Bratten, 32, and Randall Burgess Jr., 19, are charged with facilitation in the slaying.

Commonwealth’s Attorney David Smith said an order was signed in May to delay the trial by mutual consent of the prosecution and defense.

Matthew Denholm and another man, Patrick Keene, face two counts of murder in a separate 2010 case. They are accused of carrying out a “hit” on Charles Walker and also killing his girlfriend, Sonsaray Warford. Police did not find the couple’s bodies until March 2012.

The double-homicide trial originally was slated to begin Aug. 12.

Smith said evidence is still being gathered and presented in connection with Walker and Warford’s deaths, and it was necessary to delay trying either murder case until the investigation is complete.

No formal decision has been made on whether to pursue the death penalty against the defendants in either case, Smith said. He added that discussions were ongoing with the defense teams.
