Man indicted for forcing child to ‘ingest feces’

By Brian Smith
Register News Writer

A Goodloe Chapel Road resident was indicted Thursday on charges of first-degree criminal abuse and being a persistent felony offender after allegedly beating a 4-year-old boy and forcing him to eat feces.

Craig Freeling Shearer, 30, is accused in the indictment of committing the offense between March 1 and April 10 by “intentionally beating ... a 4-year-old child, and forcing (the child) to ingest feces, thereby placing (the child) in a situation that may have caused him to suffer a serious physical injury and causing him torture and/or cruel punishment.”

The persistent felony offender charge stems from a 2007 conviction in Madison Circuit Court on methamphetamine possession and fourth-degree assault charges, the indictment alleges.

As a result of the persistent felony offender charge, the first-degree criminal abuse charge is a Class B felony punishable by 10 to 20 years in prison if convicted.

Drug trafficking by mail

A Waco woman is accused of allegedly possessing prescription drugs with the intent to mail them to a man in a Texas drug treatment facility.

Kendra Arvin, 24, of the 1000 block of College Hill Road, is charged with one count each of first-, second- and third-degree trafficking in a controlled substance.

According to the indictment returned Thursday by a Madison County grand jury, Arvin is accused of “knowingly and unlawfully possessing” OxyContin, hydrocodone and Xanax “with the intent to transfer it by mailing it” to a man in a drug treatment facility in Galveston, Texas, on Oct. 28 of last year.

First-degree trafficking is a Class C felony punishable by five to 10 years in prison if convicted, while second-degree trafficking is a Class D felony punishable by one to five years imprisonment. Third-degree trafficking is a Class A misdemeanor punishable by 12 months in jail if convicted.

Other indictments

• Michael D. Short, 23, and Robert Albro Jr., 47, both of Richmond, for first-degree trafficking in a controlled substance, a Class C felony, possession of drug paraphernalia and possession of marijuana, both Class A misdemeanors. Albro also faces a charge of carrying a concealed deadly weapon, also a Class A misdemeanor.

• Shaquille Williams, 20, of Race Street, Richmond, for first-degree trafficking in a controlled substance, a Class C felony, third-degree trafficking in a controlled substance and possession of drug paraphernalia, both Class A misdemeanors.

• Donald Newcomb, 29, of Mount Vernon, for first-degree possession of a controlled substance, a Class D felony, possession of drug paraphernalia, a Class A misdemeanor, driving under the influence and being a persistent felony offender.

• Michael A. Celeri, 49, listed as homeless, for theft by unlawful taking, a Class D felony.

• Nena Jo Martin, 41, of Sara Leigh Drive, Richmond, for making false statements to receive more than $100 in benefits, a Class D felony.

• Robert Carrier, 22, of Kayla Drive, Berea, for first-degree criminal mischief, a Class D felony.

An indictment is a formal statement of charges and does not imply guilt.
