Detroit man receives 11-year sentence for drug trafficking

RICHMOND — A Detroit man who was dealing large quantities of pills in Richmond was sentenced to a total of 11 years in prison Thursday in Madison Circuit Court.

Terry Colbert, 47, had earlier pleaded guilty to two counts of trafficking in a controlled substance (first offense), trafficking in a controlled substance (second or greater offense) and convicted felon in possession of a handgun.

The Commonwealth’s Attorney’s Office recommended a sentence of 10 years on each of the first-offense trafficking charges, one year on the second-or-greater-offense trafficking charge and five years on the handgun charge for a total of 10 years.

In a second case, Colbert had pleaded guilty to first-degree bailing jumping and was sentenced to one year in prison, which will run consecutively to the 10-year sentence.

Colbert’s attorney argued for probation, stating the man could become a “model citizen” as evidenced by his position as a trusty at the Madison County Detention Center.

“He’s made the best of a bad situation,” the attorney said.

Judge Jean C. Logue said she often found it disappointing when obviously bright people “use their entrepreneurial skills in the wrong fashion.”

She added that probation was not appropriate in cases of “out-of-town people coming here for the sole purpose of trafficking.”

Colbert was arrested June 22, 2011, when officers with the Central Kentucky Area Drug Task Force searched the Richmond home where he was staying and found large quantities of pills, several weapons and $5,000.

The drugs included oxycodone, Vicodin and Xanax, according to the CKADT spokesperson.

Colbert was released from jail June 30, 2011, after posting a $15,000 bond but was re-arrested Sept. 14 and charged with bail jumping.

His attorney asked the judge to recommend Colbert for substance-abuse treatment while he was in prison, and Logue agreed.

“It might be a good time to start a new chapter,” Logue said when Colbert mentioned he had recently become a father for the third time.

Colbert went on to say he was brought up in a family in which drugs were a way of life. Logue pointed out he needed to be a better role model for his children.

“Kids pay attention to what you do,” the judge said.
